TERMS AND CONDITIONS

1. GENERAL

Kauf is a sole trader business located at : Carver house, carver street, Sheffield, S1 4FS

Kauf can be reached for any questions regarding the Terms and Conditions and matters connected to any orders or purchases on the following email address: info@kaufstudio.co

These Terms and Conditions govern the selling terms of all orders placed by customer(s) (hereinafter referred to as “you” or the “customer”) on the domain www.kaufstudio.co from the moment you place an order until payment and delivery. By ordering a product, you agree to be legally bound by these Terms and Conditions. Please make sure you have read and understood them before placing an order.

2. PLACING AN ORDER

By placing an order on the site, you are offered to purchase products subject to these Terms and Conditions. On site you will follow the steps below in completing your order.

• Find the product(s) you want on the Kauf website
• Select the size you require and press ‘Add to Cart’
• Once you’ve added all of the items you require to your cart, select checkout option
• You will be asked to input your shipping and billing details
• Review your order to ensure all items and details are correct
• Press ‘Complete Order’

You will then receive an order confirmation via email to the email address provided at the time of ordering,

In the unlikely circumstance we are unable to fulfil your order for whatever reason, an email will be sent to the address supplied by yourself when you placed the order explaining the issue that may have arisen and all possible solutions.

Remember to check your cart and delivery information to ensure your order is correct before pressing the ‘Place Your Order’ button, as we may not be able to amend or cancel your order once it has been submitted. Please email info@kaufstudio.co and we will do our best to help you, but please note order cancellations or changes to orders may not be possible.

Kauf reserves the right to reject or cancel your order fulfilment of all orders placed on the Kauf website. We reserve the right to not accept your order for any of the following reasons:

• The product is not available / in stock
• Your billing information is not correct or not verifiable
• Your order has been suspected of fraudulent activity
• We could not deliver to the address provided by yourself
• Force Majeure
• In the event of misspelling, pricing or other errors or mistakes in the website information

We may refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from the website at any time, whether or not that particular product has been sold out.

3. ELIGIBILITY TO PURCHASE

In order to make purchases through the website, you are requested to provide your personal details. Customers must provide their real name, billing address, shipping address, phone number, e-mail address and other requested information as indicated. Furthermore, when ordering items, you will be required to provide your payment details, and you represent and warrant that the payment details you provide on ordering are both valid and correct. Our site is only available for use to individuals who meet our terms of eligibility and who have been issued with a valid debit/credit card by a bank acceptable to Kauf and whose applications are acceptable to Kauf. Kauf reserves the right to refuse to ship multiple items to any one customer or postal address.

By making an offer to purchase Kauf merchandise you expressly authorise us to perform credit checks and where we deem necessary, to request additional information from third parties in order to authenticate your identity and validate your credit/debit card details in order to process your order.

4. NEWSLETTER SUBSCRIPTION

To make a purchase on our website you are not required to register. You can proceed to checkout as a visitor should you not wish to open an account. However, to be able to use some of the services and features or to be notified of any promotional offers, discounts and/or special events, you will need to create an account or subscribe to our newsletter. You do not need to create an account to subscribe to our newsletter, but can opt to do so once you have created an account and have signed in. The account password you provide should kept secure. You must notify Kauf immediately of any breaches in security or unauthorised use of your account. 

5. PRICING

The prices are indicated in GBP. The prices of the goods will be as quoted on the website when you confirm your order (when you ‘checkout’) subject to inadvertent technical errors that we will not be liable for.

If you later amend your order, the prices charged will be those applicable to the items at the time that the amended order is confirmed.  Please note that as promotions are offered for limited periods of time, subsequent amendments to your order may mean that certain promotions are no longer offered.

Prices of goods do not include any delivery charges.

Shipping rates are applied per order. The exact shipping rates depend on the country where your order is being delivered.

Prices may vary across stores.

Kauf reserves the right to change the price of a product at any time without any forewarning. Any orders placed prior to this change cannot be amended to the revised price.

Please note that your order may be subject to import duties and taxes over which we have no control as they are levied by your tax and customs office. As the customer and importer of the goods, you will be responsible for these charges. Import duties or tax costs will be invoiced to you directly from the appointed forwarder. We recommend you contact your local customs authority to determine a landed cost price prior to purchase completion. Kauf is not responsible for any delays on goods that have been held back as a result of procedures carried out by your local customs authorities.

Sale price adjustment policy

Only on request by the client will Kauf offer a Sale Price Adjustment on items purchased up to 4 days prior to the commencement date of a sale. Please note that the exact style and size of an item must be available for purchase at the time your request is made before an adjustment in the sale price can be approved. All approved sale price adjustments will be created in the form of a store credit, which will be valid for 6 months and can be redeemed by contacting us directly by email 

Kauf will not offer a price adjustment on items originally purchased in a sale or any other promotion that are temporarily reduced in price. Once an item has been purchased at a discounted price or sale, no price adjustment will be offered should a further sale or price reduction follow.

6. PAYMENT

By Card or PayPal

We accept payment in GBP only.

Payment can be made by Visa, MasterCard, American Express, Maestro, Paypal. Apple pay, Google pay, Shopify pay. Debit and credit card payments are processed via Shopify pay, a secure payment gateway provider.

PayPal is an online payment processing company widely used on the Internet to facilitate sales transactions, including credit card payments. When you proceed with making your online purchase and you select PayPal as a method of payment you will be transferred to the PayPal site where your transaction will be processed. You do not need a PayPal account and there is no additional cost to you. For more information about PayPal, follow this link www.paypal.com.

Payment will be debited and cleared from your account upon receipt of an order acknowledgement email. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to Kauf, we will not be liable for any delay or non-delivery.

Kauf’s website and online shop are hosted by Shopify.

We take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the site.

Promotion codes & credit notes

Promotion codes are non-transferrable and there are no cash alternatives. If provided, they must be redeemed by the date published. Credit notes are non-cash transferable and must also be used within the allocated period either by emailing and specifying the product(s) you wish to redeem your credit on.

 

 

DELIVERY

Kauf aims to dispatch your order within 21 days of receipt of payment details – excluding weekends, bank holidays and public holidays. This is subject to credit clearance and availability of stock. Items that are handmade to order in our studio require up to 3 weeks to produce. Orders including both 'in stock' and 'made to order' items will be held until all items are ready for dispatch. If you require your 'in stock' items earlier, please contact us at info@kaufstudio.co for more information. You may be liable to pay additional shipping charges for orders split over multiple deliveries.

As soon as the shipping for your order has been booked you will receive a dispatch confirmation with the tracking number from us, together with details on how to track your order, via email. Please note that these services might not be available during the festive and pre-festive days. Also note that any estimated delivery times are to be used as a guide only, and Kauf is not responsible for any delays caused by destination customs clearance processes.

Kauf insures each purchase for the time it is in transit only. A signature is required for any goods delivered, at which point responsibility for your purchased goods is passed to you. 

Shipping

Shipping costs are calculated at checkout.

Standard shipping: Orders are shipped domestically and internationally using the quickest available tracked Royal Mail/overseas national postal system service.

Rest of the World – Standard £9

Free shipping within the UK will be applied automatically to orders with a value of £150 or more after any discounts have been applied.

7. Intellectual Property

The contents are the property of Kauf. Such content includes but is not limited to all photographs, images, illustrations, texts, video clips, drawings, logos, registered trademarks, graphics and other materials appearing on this site. All rights are reserved worldwide. This site is intended solely for private, personal and non-commercial use. You may download or re-produce information appearing on this site solely for personal and non-commercial purposes. With the exception of personal and non-commercial use, you are prohibited from re-producing, publishing, transmitting, disseminating, displaying, erasing, deleting, adding to or modifying in any way whatsoever, creating derivative works from, selling or participating in the sales of any part of this site. Any other use of the articles contained on this site, including their reproduction for purposes other than your personal and non-commercial use, modification, dissemination or reproduction without Kauf’s prior written consent is strictly forbidden.

8. Disclaimer

Kauf has endeavoured to display its products and colours as accurately as possible. We cannot guarantee that the colour you see on your monitor will be the exact match of the colour of the goods delivered. We undertake to provide as accurate and exact a service as possible; nevertheless, technical, factual and/or printing errors may occur. Kauf reserves the right to make changes and corrections to the website whenever necessary, without advance warning. Errors will be corrected where discovered and Kauf reserves the right to revoke any stated offer and to correct any (technical) errors, inaccuracies or omissions including after an order has been acknowledged and whether or not your PayPal account has been charged. If your PayPal account has been charged for a purchase and your order is cancelled, Kauf will credit your PayPal account in the amount of the charge (less any applicable charges levied by PayPal according to your individual Terms and Conditions).

 

9. Governing Law

The Terms and Conditions together with all our policies and procedures are governed by British law and the relevant courts of the United Kingdom will have exclusive jurisdiction.

Kauf reserves the right to amend these Terms and Conditions at any time. The new version will not be retroactive and the parties shall only be bound by the Terms and Conditions which are online the day the order is placed.
